(1) The Governor may make regulations, not inconsistent with this Act, for or
with respect to--
(a) any matter that by this Act is required or permitted to
be prescribed or that is necessary or convenient to be prescribed for carrying
out or giving effect to this Act, and
(b) any matter for or with respect to
which rules may be made under Division 2 of Part 3.
(2) If there is any
inconsistency between the regulations and the rules made under Division 2 of
Part 3, the regulations prevail to the extent of the inconsistency.
(3) A
regulation may create an offence punishable by a penalty not exceeding 5
penalty units.
(4) A reference in Division 1 of Part 3 to the rules includes
a reference to regulations in so far as the regulations make provision for or
with respect to any of the matters mentioned in that Division.
