HOMEFUND COMMISSIONER ACT 1993 - SECT 8
Principal functions
(1) The principal functions of the Commissioner are to receive complaints from
HomeFund borrowers arising from the promotion of, negotiations for, entering
of, terms of, and administration and enforcement of, the HomeFund mortgages to
which they are or were parties, and (in connection with any such complaints):
(a) to provide advice about the relief and remedies available to
HomeFund borrowers,
(b) to refer HomeFund borrowers to appropriate
authorities,
(c) to investigate complaints,
(d) to conciliate complaints,
(e) to make determinations in accordance with this Act.
(2) The Commissioner
may exercise the functions of providing advice, referring borrowers and
conciliating complaints before, during, following or without an investigation.
(3) The Commissioner may make recommendations to persons who appear to be
materially involved in the subject-matter of a complaint. Any such
recommendation may be made before, during, following or without an
investigation, and whether or not the Commissioner has made or proposes to
make any determinations.
(4) The Commissioner is, to the extent considered
appropriate by the Commissioner, to keep records and to collate and assess
information in connection with functions under this Act and, in particular, to
facilitate the making of reports and recommendations as occasion requires.
