Obstruction of officers and others
128 Obstruction of officers and others
(1) A person must not, without reasonable excuse: (a) hinder or obstruct any
officer of the Department of Fair Trading so as to interfere with the exercise
of the officer’s functions under this Act, or
(b) hinder or obstruct the
holder of an authority under section 126 so as to interfere with the exercise
of the holder’s functions under that section, or
(c) being an occupier of
any land, building, vehicle or vessel entered under such an authority, fail to
provide the holder of the authority with such facilities and assistance as are
reasonably requested by the holder for the exercise of the holder’s
functions.
Maximum penalty: 40 penalty units in the case of a corporation and
20 penalty units in any other case.
(2) A person is not guilty of an offence
under this section involving an authority under section 126 unless the
authority was, before the alleged offence occurred, produced for inspection by
the person.
