Designated land not affected by, and not to affect, acquisition, transfer etc of surrounding land
18 Designated land not affected by, and not to affect, acquisition, transfer
etc of surrounding land
(1) The vesting of designated land in the Authority is not affected by any
acquisition (including compulsory acquisition) of the land in which
designated land is situated or by any dealing in connection with that land.
(2) A dealing in connection with land in which designated land is situated is
not affected by the existence of the designated land or by the failure to
disclose the existence of the designated land.
(3) In particular, in
connection with any conveyance or transfer, a vendor of the land is not
required to disclose the existence of the designated land and a purchaser of
the land is not entitled to make any requisition, objection or claim for
compensation, or refuse to complete the purchase, because of the existence of
the designated land.
(4) However, subsections (2) and (3) do not apply to any
designated land referred to in section 17 (3).
(5) In this section,
"dealing" includes conveyance and mortgage (within the meaning of the
Conveyancing Act 1919 ) and testamentary disposition.
