Requirement to forfeit hardship gaming machines in certain circumstances

30 Requirement to forfeit hardship gaming machines in certain circumstances

(1) If the Authority approves of a hotelier or registered club keeping any hardship gaming machines, the hotelier or club must forfeit to the Authority the approval to keep those gaming machines before any poker machine entitlement allocated in respect of the hotel licence or the premises of the club can be transferred under Division 2 of this Part.
(2) Subsection (1) does not apply to or in respect of a hotelier or registered club after the period of 3 years following the date (as determined by the Authority) on which hardship gaming machines were approved to be kept in the hotel or on the club’s premises.
(3) Subject to the regulations, if a hotel licence is removed under the Liquor Act 2007 to other premises that are not situated in the same local government area as the previous premises, the hotelier must:
(a) forfeit to the Authority the approval to keep any hardship gaming machine in the hotel, and
(b) surrender to the Authority the authorisation under Part 5 to keep any approved amusement device in the hotel.
