Suspension or cancellation of licences by Regulatory Authority
29 Suspension or cancellation of licences by Regulatory Authority
(1) The Regulatory Authority may suspend or cancel a game hunting licence as
provided by this section.
(2) The Regulatory Authority is to cancel a game
hunting licence if the holder is not qualified, or is no longer qualified, to
hold the licence.
(3) The Regulatory Authority is to suspend or cancel a game
hunting licence--
(a) if the holder contravenes any mandatory provision of the
code of practice referred to in section 24, or
(b) if the holder is found
guilty of an offence in New South Wales or elsewhere involving cruelty to
animals, or
(c) if the holder has been found guilty of an offence under
section 55.
(4) The Regulatory Authority may suspend or cancel a game hunting
licence--
(a) if the holder contravenes a condition of the licence, or
(b) if
the holder is found guilty of an offence in New South Wales or elsewhere
involving harm to animals, personal violence, damage to property or unlawful
entry into land, or
(b1) if the holder is found guilty of an offence under
the Firearms Act 1996that is, in accordance with section 84 of that Act, an
offence that may be (or is required to be) prosecuted on indictment, or
(c)
in such other circumstances as are prescribed by the regulations.
(5) The
Regulatory Authority may, if it cancels a game hunting licence, disqualify the
person who held the licence from holding or obtaining such a licence for a
period specified by the Regulatory Authority.
(6) The Regulatory Authority
may at any time remove the suspension of a game hunting licence (except a
suspension imposed by a court).
