Tribunal’s review of appointment
6J Tribunal’s review of appointment
(1) The Tribunal: (a) may, on its own motion, and
(b) must, at the request of
any person who, in the opinion of the Tribunal, has a genuine concern for the
welfare of the appointor,
review the appointment (or purported appointment) of
an enduring guardian.
(2) Before carrying out the review, the Tribunal must
cause a notice specifying the date on which, and the time and place at which,
the Tribunal will carry out the review to be served on each party to the
review.
(3) The Tribunal may, by order, suspend the appointment (or purported
appointment) of the enduring guardian until the Tribunal takes action under
section 6K (1).
(4) A failure to serve notice in accordance with this section
does not vitiate the decision of the Tribunal on the review.
