Order (other than interim order) prohibiting or restricting the supply of goods
31 Order (other than interim order) prohibiting or restricting the supply of
goods
(1) The Minister may make a conditional or unconditional order prohibiting or
restricting the supply of specified goods or goods of a specified kind: (a)
after considering a report and any recommendation of the
Products Safety Committee relating to the goods,
(b) after considering a
report of an authority of the State relating to the goods and deciding to make
the order without referring a question to the Products Safety Committee, or
(c) if a like prohibition or restriction is in force under another law of the
State, a law of the Commonwealth or a law in force elsewhere in Australia
because the goods are dangerous.
(1A) An order made under this section must
be published in the Gazette.
(2) Sections 40 and 41 of the Interpretation Act
1987 apply to an order made under subsection (1) as if it were a statutory
rule to which those sections apply.
