FREIGHT RAIL CORPORATION (SALE) ACT 2001 - SECT 25
Status of sale company
(1) The sale company is an agency through which the State carries out the
activity of providing freight rail services, and for that purpose it is a
public authority of the State.
(2) However, the sale company: (a) is not, and
does not represent, the State except by express agreement with the Treasurer,
and
(b) is not exempt from any rate, tax, duty or other impost imposed by or
under any law of the State merely because it is a company in which the shares
are held for and on behalf of the State, and
(c) cannot render the State
liable for any debts, liabilities or obligations of the sale company, unless
this Act or any other Act or law otherwise expressly provides.
