FINES ACT 1996 - SECT 20
What is a penalty notice?
(1) A penalty notice is a notice referred to in subsection (2) to the effect
that the person to whom it is directed has committed a specified offence and
that, if the person does not wish to have the matter dealt with by a court,
the person may pay the specified amount for the offence to a specified person
within a specified time.
(2) A penalty notice for the purposes of this Act
is: (a) a notice issued under any of the statutory provisions set out in
Schedule 1, or
(b) any similar notice issued under any statutory provision
specified by the regulations for the purposes of this section, or
(c) a
notice issued under a statutory provision that declares the notice to be a
penalty notice for the purposes of this Act, or
(d) a notice that, at the
time it was issued, was issued under a statutory provision referred to in
paragraph (a), (b) or (c).
(3) A notice is not a penalty notice for the
purposes of this Act unless it is of a kind referred to in subsection (2).
