Enforcement of forfeited bail money
112 Enforcement of forfeited bail money
(1) Part 4 (Fine enforcement action) applies to forfeited bail money as if the
amount payable were a fine imposed by a court for an offence.
(2) The
application of that Part is subject to the following: (a) the
State Debt Recovery Office is to make a court fine enforcement order for the
purposes of taking enforcement action (being a form of order that is
appropriate to the circumstances of the case),
(b) enforcement costs are not
payable on the making of the order,
(b1) if the State Debt Recovery Office is
served with a copy of an application or appeal duly made under section 53K or
53N of the Bail Act 1978 in relation to forfeited bail money, action under
Part 4 may not be commenced or continued until proceedings on the application
or appeal are finally determined,
(c) all other necessary or prescribed
modifications to the application of that Part apply.
