FORESTRY ACT 1916 - SECT 7
Incorporation
7 Incorporation
(1) For the purposes of this Act the person for the time being holding the
office of commissioner is constituted a corporation sole under the name of the
Forestry Commission of New South Wales, with perpetual succession and a seal
of office, and may in that name sue and be sued and proceed and be proceeded
against in all courts.
(1A) The commission: (a) subject to subsection (3),
may, for the purposes of this Act, take, purchase, exchange, take on lease,
hold, sell, let on lease, mortgage or otherwise acquire, dispose of or deal
with real or personal property, and
(b) may do and suffer all other things
that bodies corporate generally may, by law, do and suffer and that are
necessary for or incidental to those purposes.
(2) Where any property or
interest therein or charge thereon is vested in or acquired by the commission
the same shall, unless otherwise disposed of by the commission in accordance
with this Act, pass and devolve to and vest in the successors of
the commission.
(3) It shall not be lawful for the commission to exchange,
sell, mortgage or otherwise dispose of any real property vested in it, unless
in accordance with the express provisions of this Act, or when no express
provision is made, unless with the approval of the Governor.
(4) In the
exercise of its functions under this or any other Act, the commission may use
the name “Forests NSW”.
