Offences relating to the grazing of animals and the occupation or use of land
32 Offences relating to the grazing of animals and the occupation or use of
land
(1) A person shall not, without lawful authority, graze or water animals on
any land within a State forest, timber reserve or flora reserve. Penalty: 20
penalty units.
(2) A person shall not, without lawful authority, occupy or
use any land within a State forest, timber reserve or flora reserve. Penalty:
20 penalty units.
(3) In proceedings for an offence arising under this
section, the defendant has the onus of proving lawful authority in relation to
the act giving rise to the alleged offence.
(4) A penalty may be imposed
under this section in relation to the grazing or watering of animals on any
land or the occupation or use of any land in addition to any penalty, fine or
forfeiture imposed by any lease from the Crown lawfully in force in respect of
that land.
