149 Holder of certificate may deal with certificate
(1) The person
registered as the owner of an energy savings certificate may, subject to this
Part, deal with the certificate as its absolute owner and give good discharges
for any consideration for any such dealing.
(2) This section is subject to
any rights appearing in the register of energy savings certificates to belong
to another person, being rights that are registered in accordance with any
regulations made under this Part.
(3) This section only protects a person who
deals with the person registered as the owner of the energy savings
certificate as a purchaser in good faith for value and without notice of any
fraud on the part of the registered owner.
(4) Despite subsection (3), a
person who purchases an energy savings certificate in good faith for value
does not lose the protection provided by this section because the person has
notice that a person has been found guilty of an offence against this Part in
respect of the creation of an energy savings certificate.
Note: This Part
makes it an offence to improperly create an energy savings certificate. The
Scheme Administrator may require a person who has been convicted of such an
offence to “make good” the improper creation of the certificates by
surrendering to the Scheme Administrator an equivalent number of certificates
to those improperly created. It is not necessary for those certificates to be
the actual certificates improperly created (as those certificates may already
have been sold).
