Post-determination notification
81 Post-determination notification
(1) The consent authority must, in accordance with the regulations, notify its
determination of a development application to: (a) the applicant, and
(b) in
the case of a development application for consent to carry out
designated development, each person who made a submission under section 79
(5), and
(c) such other persons as are required by the regulations to be
notified of the determination of the development application.
(2) If the
consent authority is not the council, the consent authority must notify the
council of its determination.
(3) In the case of a development application
for consent to carry out designated development, the consent authority must
also notify each person who made a submission under section 79 (5) by way of
objection of the person’s rights to appeal against the determination and of
the applicant’s rights to appeal against the determination.
(4) For the
purposes of this section,
"designated development" includes State significant development that would be
designated development but for section 77A (2), and accordingly a reference in
this section to section 79 (5) includes a reference to section 89F (3).
