ENTERTAINMENT INDUSTRY ACT 1989 - SECT 60
Evidentiary certificates
60 Evidentiary certificates
(1) If in any legal proceedings it is proved that on a certain day or during
any period a person was the holder of a licence, it is to be presumed, in the
absence of proof to the contrary, that the person was carrying on the business
of, or otherwise acting as, an entertainment industry representative on that
day or during that period.
(2) A certificate purporting to be signed by the
Chairperson of the Council or an officer authorised by the Council for the
purposes of this section certifying: (a) that a person was or was not on a
specified date a holder of a licence, or
(b) that particulars specified in
the certificate were on a specified date the particulars specified in a
licence, or
(c) that a licence specified in the certificate was on or during
any specified period or date cancelled or suspended, or
(d) that a direction
under section 36 or 37 specified in the certificate was on a specified date
issued in the specified manner to the person,
is admissible in evidence in any
proceedings and is evidence of the matters stated in the certificate.
