Notice of refusal
23 Notice of refusal
(1) If the Council refuses to issue a licence, the Council is required to
cause notice of the refusal, and of the grounds for the refusal, to be served
on the applicant.
(2) In the case of an application made by more than one
person, it is sufficient if the notice is served on any one of the applicants.
(3) If, at the expiration of 90 days after an application has been made the
Council has failed to determine the application, the Council is to be taken,
for the purposes of any application to the Administrative Decisions Tribunal
for a review under this Act, to have refused the application concerned.
(4)
If an application for a licence is refused, the Council may (having regard to
any costs incurred by it in respect of the application) refund the whole or
part of any fees paid in respect of the application.
