17 Constitution of Complaints Committee for purposes of inquiries
(1) The Complaints Committee, for the purposes of conducting and determining
an inquiry under this Part, is to be constituted by any 3 of its members, of
whom one is to be the Chairperson.
(2) The Chairperson is to determine which
of the members of the Complaints Committee is to constitute the Committee for
any particular inquiry.
(3) Despite subsection (1), the Complaints Committee
may be constituted by the Chairperson alone, but only if both parties to the
inquiry concerned agree to the Complaints Committee being so constituted.
(4)
More than one inquiry by the Complaints Committee may be conducted at any one
time.
(5) For the purposes of subsection (4), the Chairperson of the
Complaints Committee is authorised to appoint a member of the Committee as
Chairperson for a particular inquiry.
(6) A decision of the
Complaints Committee when constituted by 3 members must be supported by at
least 2 members of the Committee.
