Relationship to other laws

5 Relationship to other laws

(1) Subject to this section, where, by or under any other Act, any provision is made relating to a substance that is an environmentally hazardous chemical or a declared chemical waste, the provision so made shall be observed in addition to the provisions of this Act, the regulations and orders made under this Act, but no person is, by virtue of this subsection, liable to be punished twice for the same offence.
(2) Where, by or under any other Act (other than the Radiation Control Act 1990 or the Protection of the Environment Operations Act 1997 ), any provision is made relating to the protection of the environment from the effects of chemicals and chemical wastes, being a provision that is inconsistent with a provision of this Act, a regulation or an order made under this Act, the provision of this Act or the regulation or order shall prevail.
(3) Nothing in this Act affects the operation of the Radiation Control Act 1990 or the Protection of the Environment Operations Act 1997 or any regulations made under those Acts.
