EXHIBITED ANIMALS PROTECTION ACT 1986 - SECT 42
Search warrant
42 Search warrant
(1) In this section:
"authorised officer" has the same meaning as it has in the Law Enforcement
(Powers and Responsibilities) Act 2002 .
(2) An inspector may apply to an
authorised officer for the issue of a search warrant if the inspector has
reasonable grounds for believing that a provision of this Act or the
regulations has been or is being contravened in any dwelling.
(3) An
authorised officer to whom an application is made under subsection (2) may, if
satisfied that there are reasonable grounds for doing so, issue a search
warrant authorising an inspector named in the warrant, when accompanied by a
member of the police force: (a) to enter the dwelling, and
(b) to search the
dwelling for evidence of a contravention of this Act or the regulations.
(4)
Division 4 of Part 5 of the Law Enforcement
(Powers and Responsibilities) Act 2002 applies to a search warrant issued
under this section.
