Reference of question as to qualification or vacancy
246 Reference of question as to qualification or vacancy
(1) The Assembly
may by resolution refer to the Court of Disputed Returns any question
respecting-- (a) the qualification of a member to be or continue as a member
of the Assembly, or
(b) a vacancy in the Assembly.
(2) The Council may by
resolution refer to the Court of Disputed Returns any question respecting--
(a) the qualification of a member to be or continue as a member of the
Council, or
(b) a vacancy in the Council.
(3) The Court of Disputed Returns
has jurisdiction to hear and determine such a question.
