26 Guidelines by Attorney General
(1) In the exercise of the Director’s functions, the Director is subject to
such guidelines as the Attorney General, after consultation with the Director,
furnishes to the Director by order in writing.
(2) Without limiting the
generality of subsection (1), guidelines may relate to the circumstances in
which the Director should institute or carry on prosecutions for offences.
(3) A guideline may not be furnished in relation to a particular case.
(4) If
the Attorney General furnishes a guideline under this section, the Attorney
General shall: (a) as soon as practicable after furnishing it, cause a copy of
the order to be published in the Gazette, and
(b) cause a copy of the order
to be laid before each House of Parliament within 14 sitting days of that
House after publication.
(5) For the purposes of this section, sitting days
shall be counted whether or not they occur during the same session.
