Identification of persons offering driving instruction
51 Identification of persons offering driving instruction
(1) A police officer or an authorised officer who suspects on reasonable
grounds that a motor vehicle is a vehicle used, or sometimes used, for the
purpose of teaching any person to drive or for the purpose of advertising a
driving school or advertising the fact that any person is willing to act as a
driving instructor, may require: (a) the owner of the vehicle, or
(b) the
person who has custody of the vehicle, or
(c) if the vehicle is registered
under the Road Transport (Vehicle Registration) Act 1997 (or registered or
licensed under the law of any other State, or of any Territory or country that
corresponds to the requirements of that Act relating to the registration of
motor vehicles)-the person in whose name the vehicle is registered,
to give to
the officer such information relevant to the provision of driving instruction
in connection with the vehicle and the activities of the driving school and
the identity of persons connected with it as it is within the power of the
person to give.
(2) A person must not, without reasonable excuse, fail to
comply with a requirement under this section. Maximum penalty: 50 penalty
units.
