Evidence as to Authority’s records
46 Evidence as to Authority’s records
(1) A certificate purporting to be signed by an authorised officer and to
certify that on any date or during any period specified in the certificate the
particulars set out in the certificate as to any of the matters referred to in
section 45 did or did not appear on or from the Authority’s records is, in
all courts and on all occasions, evidence of the particulars certified by the
certificate.
(2) In particular, a certificate purporting to be signed by an
authorised officer and to certify that on any date or during any period
specified in the certificate: (a) a specified person was or was not the holder
of a licence, or
(b) a licence held by a specified person was or was not
subject to a specified condition, or
(c) a specified person was or was not
subject to a specified prohibition order, or
(d) a specified notice or
document was served under this Act on a specified person,
is admissible in
evidence in any legal proceedings and is evidence of the particulars certified
by the certificate.
(3) This section applies without the necessity for proof
of the signature or of the official character of the person purporting to have
signed the certificate and without the necessity for the production of any
record or document on which the certificate is founded.
