Minister to issue, or refuse to issue, a permit
18 Minister to issue, or refuse to issue, a permit
(1) When investigation of an application for a permit has been completed and
all fees, charges and expenses with respect to the application have been paid,
the Minister shall consider the application and the results of the
investigation and shall: (a) issue such permit or permits for the vessel or
motor to which the application relates as the Minister considers appropriate,
or
(b) refuse to issue any permit for the vessel or motor.
(1A) The Minister
may issue a permit upon such terms, and subject to such conditions and
restrictions, as the Minister thinks fit and specifies in the permit.
(1B)
Without affecting the generality of subsection (1), the Minister may refuse to
issue a permit for a vessel or motor if it is not designed, constructed or
equipped in conformity with the provisions of the Uniform Shipping Laws Code
within the meaning of section 427 of the Navigation Act 1912 of the
Commonwealth, as amended.
(2) Where, in response to an application, the
Minister refuses to issue any permit applied for, the Minister shall give to
the applicant notice in writing of the Minister’s decision and of the
reasons therefor.
