Parties to proceedings (joint liability)
26 Parties to proceedings (joint liability)
(1) This section applies to or in respect of such classes of proceedings as
may be prescribed by the regulations.
(2) If a party in any proceedings to
which this section applies has a right to proceed against 2 or more persons
having joint liability: (a) it is sufficient if any one of those persons is
(or are) served with any notice in respect of the proceedings, and
(b) a
decision in the proceedings may be given and enforced against the person or
persons subject to the liability.
(3) Section 95 of the Civil Procedure Act
2005 applies to and in respect of a decision by the Tribunal in any
proceedings to which this section applies in the same way as section 95 of
that Act applies to and in respect of a judgment given in proceedings before
the Supreme Court.
(4) If at any time the Tribunal is of the opinion that a
person should be joined as a party in proceedings to which this section
applies, the Tribunal may, by notice in writing given to the person or by oral
direction during the proceedings, join the person as a party in the
proceedings.
