CORPORATIONS (NEW SOUTH WALES) ACT 1990 - SECT 96
References to Corporate Affairs Commission
(1) In this section:
"function" includes power, authority or duty.
"instrument" has the same meaning as in section 13, but does not include this
Act, the regulations under this Act, the Companies (Administration) Act 1981
or a prescribed instrument or prescribed part of an instrument.
"Managing Director" means the Managing Director of Business and Consumer
Affairs.
(2) A reference in an instrument to the Corporate Affairs Commission
or the Commissioner for Corporate Affairs is to be taken to be a reference to
the Managing Director or to such officer or body (whether of this State or
not) as is prescribed by regulations under section 80.
(3) Subsection (2)
extends to a reference required by section 18 of the Companies
(Administration) Act 1981 to be construed as a reference to the Corporate
Affairs Commission.
(4) The Managing Director may delegate any of the
functions conferred or imposed on the Managing Director because of this
section.
(5) Except in so far as the instrument of delegation otherwise
provides, a person to whom a function has been delegated under subsection (4)
may authorise another person to perform the function so delegated.
(6)
Section 80 (5) does not apply to the provisions of regulations made for the
purposes of or in connection with this section.
