(1) For the purposes of this Act, a
"serological clearance" is a certificate by a registered medical practitioner
or a person who provides a pathology service that:
(a) the medical
practitioner or person is of the opinion that a specified person is not
capable of transmitting to any other person any medical condition or disease
specified by the regulations for the purposes of this section, and
(b) the
opinion is based on the results of blood tests or other tests carried out on a
date specified in the certificate.
(2) A serological clearance is a
"current serological clearance" for the purposes of this Act if the tests
referred to in the clearance were carried out:
(a) in the case of a person who
is aged under 18 years--not more than 12 months before the date when the
certificate is sought to be relied on, or
(b) in the case of any other
person--not more than 6 months before the date when the certificate is sought
to be relied on.
