CHILD PROTECTION (INTERNATIONAL MEASURES) ACT 2006 - SECT 27
Matters relevant for New South Wales court in proceeding under section 23 or 26
27 Matters relevant for New South Wales court in proceeding under section 23
or 26
(1) This section applies to a proceeding in a New South Wales court under
section 23 or 26 about a foreign measure.
(2) The New South Wales court is
bound by findings of fact on which the competent authority of the
Convention country based its jurisdiction.
(3) Subject to section 26, the
New South Wales court must not review the merits of the measure.
(4) A
document of a competent authority of a Convention country is admissible as
evidence of the facts stated in the document.
(5) An affidavit of a witness
who resides outside Australia, that is filed in the proceeding, is admissible
as evidence in the proceeding, even though the witness does not attend for
cross-examination in the proceeding.
