CRIMES (FORENSIC PROCEDURES) ACT 2000 - SECT 75ZD
Refusal or failure to permit forensic procedure
(1) An
untested registrable person in respect of whom a forensic procedure is ordered
to be carried out under section 75ZC must not, without reasonable excuse,
refuse or fail to permit the forensic procedure to be carried out. Maximum
penalty: 50 penalty units or 12 months imprisonment, or both.
(2) If a police
officer suspects on reasonable grounds that a person has committed an offence
under this section, the police officer may, without a warrant, arrest the
person for the purpose of carrying out the forensic procedure concerned.
(3)
A police officer who arrests a person under subsection (2) must, as soon as is
reasonably practicable after the forensic procedure is carried out, release
the person.
(4) Nothing in this section affects any power of a police officer
to arrest and deal with the person under Part 8 of the Law
Enforcement (Powers and Responsibilities) Act 2002 .
