Submissions by State
71 Submissions by State
(1) The State may at any time make submissions to
the Review Council concerning the making of a low security classification for
a serious offender.
(2) If the State does so, the Review Council is not to
make a final decision concerning the classification of the offender until it
has taken any such submission into account.
(3) The regulations may make
provision for or with respect to submissions by the State under this section,
including provisions relating to the application of this Division in
connection with any such submission.
(4) The powers of the State under this
section may be exercised, subject to the regulations, by any agent of the
State.
(5) The power exercisable by the State under this section may also be
exercised by the Australian Capital Territory in relation to a prisoner within
the meaning of Division 4 and, for that purpose, references in this section to
the State are taken to extend to the Australian Capital Territory.
