Matters to be considered concerning certain serious offenders
154 Matters to be considered concerning certain serious offenders
(1) This
section applies to a serious offender whose sentence for life is the subject
of a determination under Schedule 1 to the Crimes (Sentencing Procedure) Act
1999 .
(2) The Parole Authority, in exercising its functions under this Part
in relation to a serious offender to whom this section applies--
(a) must have
regard to and give substantial weight to any relevant recommendations,
observations and comments made by the sentencing court, and
(b) must give
consideration to adopting or giving effect to any such recommendations,
observations and comments and to the intention of the sentencing court when
making them, and
(c) to the extent that it declines to adopt or give effect
to any such recommendations, observations and comments, must state its reasons
for doing so,
and must, in particular, have regard to the need to preserve the
safety of the community.
