Consultation with Minister or public authority
41 Consultation with Minister or public authority
(1) Where an environmental planning instrument which applies to land within
the City of Sydney provides that a development application shall not be
determined by the granting of consent without the consent, permission,
approval or concurrence of a Minister or public authority (other than the
City Council or RailCorp) to development specified in the instrument, the
Planning Committee shall, in relation to an application to carry out major
development, forward forthwith a copy of the application to that Minister or
public authority (unless consent to the application is refused).
(2) Where
development referred to in subsection (1) is designated development, the
Planning Committee shall comply with the provisions of section 79C of the
Planning Act and with the provisions of subsection (1) concurrently.
