General election of members of the trust board to be held at every third annual general meeting of commoners
32 General election of members of the trust board to be held at every third
annual general meeting of commoners
(1) A trust board must, at every third annual general meeting of commoners
after the last general meeting of commoners at which a general election was
held to elect members of the trust board, cause a general election to be held
for the purpose of: (a) filling the vacancies that will arise in the
membership of the board when the terms of office of the existing members end,
and
(b) electing the office bearers of the board from among the persons
elected to fill those vacancies.
(2) If a general election is not held as
required by subsection (1), the Minister may: (a) convene a special general
meeting of commoners for the purpose of holding such an election, and
(b)
appoint a person to preside at the meeting.
(3) In subsection (1), the
reference to the last general meeting of commoners at which a general election
was held to elect members of a trust board includes: (a) in the case of a
trust established under section 4 (1)-the general meeting of commoners
convened to elect members of that board in accordance with section 5 (2), and
(b) in the case of a trust established by section 4 (3)-the last general
meeting of commoners held before the commencement of section 4 at which new
trustees for the common were elected in accordance with section 6 of the
former Act.
