COMMONS MANAGEMENT ACT 1989 - SECT 28

Management plan may be cancelled or altered

28 Management plan may be cancelled or altered

(1) The Minister may cancel a management plan adopted under section 27, either with or without adopting another management plan in its place.
(2) If the Minister cancels a management plan under subsection (1) and, immediately before that cancellation, any by-laws were in force in respect of the common to which the plan relates, then, on the cancellation of the plan, those by-laws cease to be in force in so far as they gave effect to provisions of that plan.
(3) If a management plan is in force in respect of a common:
(a) the Minister may:
(i) cause a draft alteration to the plan to be prepared, or
(ii) direct the trust concerned to prepare, within such period as is specified in the direction, a draft alteration to the plan, or
(b) the trust concerned may, on its own initiative, prepare a draft alteration to the plan.
(4) The provisions of this Division apply to a draft alteration to a management plan in the same way as they apply to a draft management plan.
(5) When a draft alteration to a management plan relating to a common becomes operative, the plan as altered becomes the management plan in force in respect of the common.
