Dissolution of a trust-disposal of the trust property
24 Dissolution of a trust-disposal of the trust property
(1) If the setting aside of a common is revoked or otherwise terminated, the
trust established for that common is dissolved.
(2) If a trust is dissolved,
the Minister may dispose of any property of the trust in such manner as the
Minister considers appropriate.
(3) If any property which the Minister has
power to dispose of under subsection (2) is real property, the Minister may
deal with it as if it were Crown land subject to the Crown Lands Acts and not
otherwise.
(4) The Minister has power to execute transfers, conveyances and
other instruments and do any other things that are necessary to enable the
Minister to exercise the powers conferred by subsections (2) and (3).
(5) The
Minister may give directions with respect to the proceeds of sale of any
property sold under this section and, where any such directions are given,
those proceeds must be dealt with in accordance with those directions.
(6)
For the purpose of subsection (5), the proceeds of sale are the proceeds after
meeting the costs of the sale.
