CONTAMINATED LAND MANAGEMENT ACT 1997 - SECT 42A

42A Application of Division

(1) This Division applies in relation to requirements under the following (each a
"relevant order, restriction or covenant" ) to provide financial assurance to secure or guarantee funding for or towards the carrying out of actions required under the relevant orders, restrictions or covenants--

(a) management orders,

(b) ongoing maintenance orders,

(c) restrictions or public positive covenants imposed under section 29.

(2) A financial assurance is not to operate as a mere penalty for a contravention of this Act, the regulations or a management order.
