CANCER INSTITUTE (NSW) ACT 2003 - SECT 10
Chief Cancer Officer
(1) The Governor may appoint a Chief Cancer Officer. Chapter 2 of the
Public Sector Employment and Management Act 2002 does not apply to or in
respect of the Chief Cancer Officer.
(2) Subject to this Act, the
Chief Cancer Officer holds office for such period (not exceeding 5 years) as
is specified in his or her instrument of appointment.
(3) The
Chief Cancer Officer is the chief executive officer of the Cancer Institute.
(4) The Chief Cancer Officer: (a) is responsible for the management of the
affairs of the Cancer Institute, subject to and in accordance with any
directions of the Board, and
(b) has and may exercise such other functions as
are conferred or imposed on the Chief Cancer Officer by or under this or any
other Act.
(5) The Chief Cancer Officer is taken, while holding that office,
to be a member of staff of the Cancer Institute. However, nothing in this
section enables the Cancer Institute to remove the Chief Cancer Officer from
office.
(7) The Chief Cancer Officer ceases to hold office if the
Chief Cancer Officer: (a) resigns the office by instrument in writing
addressed to the Governor, or
(b) is removed from office by the Governor
under subsection (8).
(8) The Governor may remove the Chief Cancer Officer
from office at any time for any or no reason and without notice.
