9 Prohibited advertisements
(1) A person must not cause to be published any advertisement, notice or other
information promoting a gaming activity if the conduct of that activity is
prohibited by or under this Act.
: Maximum penalty--50 penalty units.
(2) It
is a defence to proceedings against a person who causes an advertisement to be
published if the person establishes that the person did not know, and could
not reasonably have known, that the gaming activity was prohibited by or under
this Act.
(3) It is a defence to proceedings against a person who causes an
advertisement to be published (the
"publisher" ) if the person establishes that--
(a) the advertisement, notice
or information was in the form provided (either directly or indirectly) or
approved by or on behalf of a person conducting or proposing to conduct the
gaming activity, and
(b) the publisher has not been notified by or on behalf
of the Secretary that the publication of the advertisement, notice or
information may contravene this section.
(4) In this section--
"publish" means disseminate, exhibit, provide or communicate by oral, visual,
written, electronic or other means (for example, by newspaper, radio,
television, the internet, cinema, billboards or other media).
