COMMISSION FOR CHILDREN AND YOUNG PEOPLE ACT 1998 - SECT 37A
Background checking for certain short-term employees
(1) This section applies to any decision by an employer to employ a person in
primary child-related employment for a period of less than 6 months or such
other period as may be prescribed by the regulations.
(2) The employer is
taken to have complied with section 37 if: (a) background checking procedures
have been carried out in accordance with that section in relation to the
person within the period of 12 months immediately preceding the employment of
the person by the employer, and
(b) the background checking procedures were
carried out in respect of a decision by the same employer to employ the person
in the same kind of primary child-related employment.
(3) The employer is
taken to have complied with section 37 if: (a) background checking procedures
have been carried out in accordance with that section in relation to the
person by an employer-related body approved by the Minister within the period
of 12 months immediately preceding the employment of the person by the
employer, and
(b) the background checking procedures were carried out in
respect of a decision by the same or another employer to employ the person in
the same kind of primary child-related employment.
