Immaterial errors not to vitiate referendum

34 Immaterial errors not to vitiate referendum

No referendum and no return or statement showing the voting on any referendum shall be avoided on account of any delay in relation to the taking of the votes of the electors or in relation to the making of any statement or return or on account of the absence or error of or omission by any officer which did not affect the result of the referendum:
Provided that where any elector was, on account of the absence or error of or omission by any officer, prevented from voting at a referendum, the court shall not, for the purpose of determining whether the absence or error of or omission by the officer did or did not affect the result of the referendum, admit any evidence of the way in which the elector intended to vote.
