Appeals as of right against Local Court’s refusal of application for annulment of conviction or sentence
11A Appeals as of right against Local Court’s refusal of application for
annulment of conviction or sentence
(1) Any defendant whose application under section 4 for annulment of a
conviction or sentence has been refused by the Local Court may appeal to the
District Court against the refusal.
(2) An appeal under this section must be
made within 28 days after the Local Court notifies the defendant of its
refusal of the application.
(3) Not more than one appeal may be made under
this section in respect of any particular conviction or sentence.
