78 Orders made with consent of parties
(1) A court may make a final apprehended violence order, or an
interim court order, without being satisfied as to the matters that are
prerequisites to the making of those orders if the protected person and the
defendant consent to the making of the order.
(2) Such an order may be made
whether or not the defendant admits to any or all of the particulars of the
application.
(3) Before making such an order, the court may conduct a hearing
in relation to the particulars of the application but only if-- (a) the order
to be made by the court is a final apprehended violence order, and
(b) the
court is of the opinion that the interests of justice require it to conduct
the hearing.
(4) In this section--
"court" includes the District Court.
