CHIROPRACTORS ACT 2001 - SECT 77
Appeal on point of law
77 Appeal on point of law
(1) When a complaint is dealt with at a meeting of
the Board under Division 4 of Part 4, the chiropractor or the Commission may
appeal with respect to a point of law to the Chairperson or a Deputy
Chairperson nominated by the Chairperson.
(2) An appeal may be made in
accordance with the regulations during the meeting of the Board to deal with
the complaint or within the period after the date of giving of notice of the
meeting and before the commencement of the meeting.
(3) If the meeting of the
Board to deal with the complaint has not been completed when an appeal is
made, the Board must not continue to deal with the complaint until the appeal
has been disposed of.
(4) The Board must not make any decision that is
inconsistent with the Chairperson’s or Deputy Chairperson’s determination
with respect to the point of law.
