CO-OPERATIVES ACT 1992 - SECT 388
Examination of involved person
(1) An Australian legal practitioner acting for an involved person: (a) may
attend an examination of the involved person by an investigator, and
(b) may,
to the extent that the investigator permits, address the investigator and
examine the involved person.
(2) An involved person is not excused from
answering a question asked by the investigator even if seeking to be excused
on the ground of possible self-incrimination.
(3) If an involved person
answers a question of an investigator after having claimed possible
self-incrimination by doing so, neither the question nor the answer is
admissible in evidence in any criminal proceedings other than: (a) proceedings
under section 390 for giving a false or misleading answer to the question, or
(b) proceedings on a charge of perjury in respect of the answer.
(4) An
involved person who attends for examination by an investigator is entitled to
be paid the prescribed allowance and the prescribed expenses.
