CO-OPERATIVES ACT 1992 - SECT 126
Notice of meeting
126 Notice of meeting
(1) At least 21 days’ written notice must be given to members of a
co-operative of a meeting at which an active membership resolution is to be
proposed.
(2) The notice must, in addition to the other matters required to
be specified: (a) specify whether the member is eligible to vote on the
resolution, and
(b) specify the full text of the proposed resolution, and
(c) contain a copy of section 127 (Cancellation of membership of inactive
member).
(3) If the notice to a member states that he or she is not eligible
to vote on a resolution, the member may, after endeavouring to settle the
matter with the co-operative, apply to the Registrar for a determination as to
the member’s eligibility.
(4) The Registrar may determine the matter, on
the information available to the Registrar, by direction in writing to the
co-operative and the member.
(5) The Registrar’s determination as to
eligibility has effect but only if given before the meeting concerned is due
to be held.
