Authorisation of construction of Railway
6 Authorisation of construction of Railway
(1) The State of South Australia is hereby authorised and empowered to
construct and maintain the Railway and such other works in New South Wales
which, pursuant to the Agreement, are to be constructed by that State and the
Railway and other works may be constructed notwithstanding the provisions of
the Public Works Act 1912 , as subsequently amended, or any other Act, and in
respect thereof the constructing authority shall be the South Australian
Railways Commissioner who shall have all the powers of a constructing
authority under the said Act, as so amended.
(2) Notwithstanding the
provisions of section 91 of the Public Works Act 1912 , as subsequently
amended, the South Australian Railways Commissioner as constructing authority
shall not be compelled nor shall it be the duty of the said authority to make
or maintain any fence along the Railway for the accommodation of any person or
for any purpose whatsoever; but the said authority may in its discretion make
and maintain such fences in connection with the Railway as it may think fit.
