BAPTIST CHURCHES OF NEW SOUTH WALES PROPERTY TRUST ACT 1984 - SECT 29
Dissolution of congregations etc
(1) If, while any trust property situated in a district is vested in the
Trust, a congregation which is or was established in the district: (a) is
dissolved or dispersed so that there are no members of a congregation in that
district meeting together for the public worship of God according to the
usages of the Baptist denomination, or
(b) consists of less than 10 members,
the Baptist Union, until a congregation having 10 members or more is again
formed in that district, or the firstmentioned congregation increases in
membership to 10 members or more, shall have and may exercise all of the
functions with respect to the trust property which the congregation would have
had and would have been capable of exercising if this section had not been
enacted, and the congregation, if any, shall not have those functions or be
capable of exercising them.
(2) Notwithstanding subsection (1), the
Baptist Union may not, pursuant to that subsection, direct the Trust to sell
or dispose of, and the Trust shall not sell or dispose of, any trust property
held by it on behalf of a congregation whose powers are affected by the
operation of that subsection: (a) where the congregation is dissolved or
dispersed, until the expiration of 6 months after the dissolution or
dispersal, or
(b) where the congregation consists of less than 10 members:
(i) unless the members of that congregation consent thereto, or
(ii) until
the expiration of a period of 2 years during which that congregation consists
of less than 10 members, whether that period commenced or commences before, on
or after the appointed day,
whichever first occurs.
