BAPTIST CHURCHES OF NEW SOUTH WALES PROPERTY TRUST ACT 1984 - SECT 13
Common seal
13 Common seal
(1) The members for the time being of the Trust shall have the custody of its
common seal and, subject to subsections (2) and (3), the form of the common
seal and all other matters relating thereto shall be as determined by the
Trust.
(2) The common seal of the Trust shall not be affixed to any
instrument except in pursuance of a resolution of the Trust and every
instrument to which the common seal is so affixed shall be signed by 2 members
of the Trust and countersigned by the secretary of the Trust or another person
duly appointed by the Trust so to do.
(3) An instrument purporting to have
been: (a) sealed with the common seal of the Trust,
(b) signed by not less
than 2 members of the Trust, and
(c) countersigned by the secretary of the
Trust or another person duly appointed by the Trust so to do,
shall, in the
absence of evidence to the contrary, be deemed to have been executed in
accordance with subsection (2).
