(1) The
determination of serious and irreversible impacts on biodiversity values for
the purposes of the biodiversity offsets scheme is to be made in accordance
with principles prescribed by the regulations.
(2) The
Environment Agency Head may provide guidance on the determination of any such
serious and irreversible impacts, and for that purpose may publish, from time
to time, criteria to assist in the application of those principles and lists
of potential serious and irreversible impacts.
